7.13 Designation of °ÄÃÅÁùºÏ²Ê¿ª½±app as a Hybrid Entity Under HIPAA

The Board of Regents of the °ÄÃÅÁùºÏ²Ê¿ª½±app (°ÄÃÅÁùºÏ²Ê¿ª½±app) engages in covered functions as defined by the Health Insurance Portability and Accountability Act of 1996, including the subsequent amendment under the Health Information Technology for Economic and Clinical Health of 2009 and any regulations promulgated under those laws, (HIPAA) and is a covered entity. Because some portions of °ÄÃÅÁùºÏ²Ê¿ª½±app are not engaged in covered functions, °ÄÃÅÁùºÏ²Ê¿ª½±app designates itself as a Hybrid Entity as defined by the HIPAA regulations.

Any portion of °ÄÃÅÁùºÏ²Ê¿ª½±app engaged in a covered function or performing business associate activities for another component of °ÄÃÅÁùºÏ²Ê¿ª½±app engaged in a covered function, as those terms are defined by HIPAA, is hereby deemed part of the Health Care Component (HCC) of the °ÄÃÅÁùºÏ²Ê¿ª½±app Hybrid Entity. The University System Office (USO) and each °ÄÃÅÁùºÏ²Ê¿ª½±app Institution will be responsible for identifying the components, business units, colleges, or schools that are part of the HCC.
